The Law.

Public Performance Rights are licenses that grant a business owner permission to play or stream a song. These performance licenses are required. Period. Whether your business is retail, a restaurant, a hotel or anything in-between, you MUST have the proper licenses to legally play/stream music.

A “public performance” is narrowly defined as any music being played outside of the comfort of your home or outside of your normal circle of friends and family.

The Risk.

What happens if you don’t secure a performance license? Will you get caught? Maybe. Maybe not. These license rights and laws are strictly enforced in the United States by performing rights organizations (BMI, ASCAP, GMR and SESAC). These organizations are no joke and actively seek out copyright violators. The results of confirmed violations can be surprise expenses and in some cases aggressive and costly legal action. As a business owner, it is critical to abide by the performance rights laws in order to lawfully play music in your establishment.
